Cain Velasquez’s plea hearing in attempted murder case delayed again

Former UFC/WWE star Cain Velasquez will have to wait until August 19th for the plea hearing in his attempted murder case in California.

The hearing was supposed to happen on August 5th, but there will be motion hearings before his official plea hearing, according to MMA Fighting. 

Velasquez is facing 10 charges after being involved in a shooting in late February. Cain followed Harry Goularte, who was charged with 1 felony count of lewd and lascivious act for allegedly molesting Valesquez’s close relative after Goularte was let out of jail under supervised release despite being charged, but was later sent back to jail.

Velasquez allegedly fired shots at the vehicle that had Goularte, his mom, and stepdad, where Velasquez hit Goularte’s stepfather. Police later found a 40-caliber semi-automatic handgun in Cain’s truck with 2-10 bullet magazines where 8 total bullets were missing from the mags. The charges against him include 1st degree attempted murder, multiple counts of assault with a deadly weapon, and shooting an occupied motor vehicle, among others. If found convicted, he faces decades in prison.

TMZ reports an extensive lawsuit has been filed against Goularte, his business Certified Custom Concrete, his mother Patricia Goularte, her business Patty’s Childcare, and his stepfather Paul Bender.

The lawsuit identifies a four-year-old victim with the initials “C.V.” who was previously identified by Velasquez’s attorney Mark Geragos as Velasquez’s son. It alleges general negligence, negligent hiring, supervision, retention, training and investigation, sexual battery, and sexual misconduct/sexual harassment.

The lawsuit documents alleged that Goularte had “daily access” to the children being cared for at his mother’s business, and was alone at times with the victim in the bathroom and the outside playhouse. Goularte is accused of removing the victim’s clothing, touching the victim’s scrotum and penis, and exposing himself to the child. Goularte is accused of doing so “numerous times during 2021 and 2022.”

The suit noted the minor child “suffered extensive personal injury including, but not limited to, severe emotional distress, humiliation, and embarrassment as a result of the actions and conduct” of Goularte. Patty’s Childcare had previously been cited for “failures to supervise the children attending the daycare.”

The first hearing for the lawsuit will come on September 6th for a conference on case management. Goularte is due back in court on his criminal case on September 20th for a preliminary hearing. Goularte faces up to eight years in prison and/or a $10,000 fine if found guilty.
